How To Start Your K1 or Fiance Visa Process

First of all, congratulations to your engagement! I know you’re both excited about filing this K1 Visa application and you must know that the process is not easy but it isn’t hard either! But it is very important that you know the K1 Visa requirements before you start the journey! :) We sent our application to USCIS on August 31st 2010 and got our NOA1 on September 9th.

Before You Apply For K1 Visa

  • Make sure that you can show evidence that you have met in person.
  • Both of you are free to marry and previous marriages should have been legally terminated by divorce, death, or annulment.
  • You intend to marry within 90 days of your fiancé(e) entering the United States.
  • You are a US citizen.
  • You must apply for a waiver if you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition.

What should your ALIEN FIANCÉ prepare and send to petitioner?

Fill out the Form G-325A, Biographic Information. Make sure that everything you provide are correct.

A passport-style color photograph that’s taken within 30 days of the date of filing this petition.
  • It must have a white background
  • Glossy
  • Not retouched and not mounted
  • Dimension of the full frontal facial image
  • Should be one inch from your chin to the top of your hair
  • Write your name at the back of the photo
Write a statement that certifies your intention to marry your fiance within 90 days of entering the US.

Provide copies of evidence that you and your fiancé have personally met in person.

  • Photos of you and your fiance together
  • Copies of Phone bills, emails, letters, or any written doc proof
  • Copies of boarding passes, iteneraries, hotel receipts, passport stamps and any other documentary evidence

What should PETITIONER prepare?

Fill out Form I-129F, Petition for Alien Fiancé(e). Make sure that everything you provide are correct. If you need an extra space, attach a continuation sheet, provide the item number, date and never forget to sign each sheet. Write “N/A” if not applicable and “none” if the answer is none.

  • Photocopy of the front and back of your birth certificate.
  • Photocopy of all the pages of your unexpired U.S. passport issued with a validity period of at least five years.

  • Copies of Phone bills, emails, letters, or any written doc proof

Cover Letter must include a description of what you are petitioning for (I-129F) and a table of contents (list everything in the packet). If you need more space to explain your case, attach a separate sheet  and list the attachment on the cover sheet. Never forget to sign and date the cover sheet.
And finally, pay $340! :D

Once the petitioner send the packet to USCIS, you both have to wait for approximately 10 days to receive the first notice. For sure, it’s going to be an exciting feeling!
